What Fixed Fee Service does Prob8 provide?
We will make one application on your behalf for a Grant of Probate (where the person died leaving a Will) or Letters of Administration (where the person died without leaving a Will) based on the information you provide to us, including your valuation of all the deceased’s assets and liabilities at the date of death. All you need to do is complete our online application and we will do the rest.
The Prob8 Fixed Fee Service is a unique online service provided by Whitehead Monckton, a leading law firm based in Kent.
When is the Prob8 Fixed Fee Service appropriate?
The Prob8 Fixed Fee Service has been designed to help people who are happy to administer the deceased’s estate themselves but wish to save the time and bother of dealing with a personal probate application.
It is therefore not appropriate where there is Inheritance Tax to pay and/or where a full Inheritance Tax Account needs to be completed. In these circumstances we would recommend our Prob8 Premium Service.
What is the benefit of using the Prob8 Fixed Fee Service?
If you make a personal application for a Grant of Probate, you will need to personally attend an appointment at the Probate Registry to give evidence on oath. Not only does this entail the inconvenience of visiting the Registry, it can also take a long time to obtain an appointment; in some cases, many weeks. It is also relatively expensive with a court fee of £90.00.
By using our Prob8 Fixed Fee Service you will:
- obtain the Grant without having to be interviewed by the Probate Registry
- not have to complete any complicated forms or documents
- save time in many cases because as solicitors we can deal with the process as a paper based application and
- save money as the court application fee is cheaper at only £40.00.
How much will the Prob8 Fixed Fee Service cost?
Our fee for providing the Prob8 Fixed Fee Service will be £300 plus VAT at the prevailing rate. Please note it is absolutely essential that the information you have provided is entirely accurate, otherwise your application may be rejected by the Probate Registry. If it is rejected for any reason, you will need to submit a new application through us, in which case the same fees will be payable again.
Therefore, should you wish to make amendments to any of the information you have provided to us in your submission form, you may do so free of charge by e-mailing us the details to info@prob8.co.uk within the next 7 days following your submission of the application form.
Any amendments notified to us after this time will incur an additional charge of £30 + VAT per change. Any additional charges incurred as a result of this provision must be paid for before we can release the probate application papers to you.
In addition, a number of out-of-pocket expenses will also be payable at the time of application. These are:
- Anti-money laundering online identity checks at £7.50 (incl. VAT) per executor
- Probate court application fee of £40.00 and
- Sealed office copies of the Grant of Probate at £1.00 per copy
What documents will I need before I start completing the online form?
We’ve put together a checklist detailing all the information you will need. Although you can save and exit the form at any point and come back to it later on, you will find it easier if you can get all the information together first before you start completing the form.
How long will it take to complete the online form?
Assuming you have all the documents and valuations to hand, it should only take you around 20 minutes to complete our application form. You can save your information at any point and come back later – just click the save button at the top right of the form.
What happens next?
Once you have completed your application form and submitted it, you will be assigned a dedicated estate administration lawyer who will draft
- the Oath (being the application form which is sent to the Probate Registry to apply for the Grant) and
- the Return of Estate Information Form (which is the simple Tax Return form sent to H M Revenue & Customs where no Inheritance Tax is payable).
We will then e-mail you drafts of the application papers for you to check and once you have approved these, the final copies will be sent for you to sign. When we receive the signed papers back from you, we shall be able to submit your probate application. Once this has been completed we will then send you the Grant of Probate with however many copies of the Grant you request when you submit your online application.
What if I get stuck or want more help?
Don't worry. At any time throughout the entire process you can upgrade your application to our Prob8 Premium Service and we will handle absolutely everything for you from then on. Should you do so, any fee you have paid as part of the Prob8 Fixed Fee Service will go towards the fee payable for using the Prob8 Premium Service so you don't end up paying for the same work twice.
